Linda A. Malek, JD, is a partner at Moses & Singer and chair of the firm’s Healthcare and Privacy practices. She advises a variety of health care entities on emerging laws and regulations affecting the health care industry, including issues relevant to privacy and technology in the context of protected health information.
Malek has extensive experience advising clients on state and federal privacy and security laws relating to the transfer of identifiable health information, the provision of health care, research and the complex privacy, security and technology issues that insurers, providers and employers face with regard to sensitive information held by them. She assists clients in performing audits of their privacy practices and in the development and implementation of their HIPAA Privacy Rule compliance plans. In addition, she counsels clients on the interaction among federal privacy and security laws and other state, federal and international laws, including state privacy laws and preemption issues regarding state law versus various federal laws, the HIPAA Privacy Rule, the Gramm-Leach-Bliley Act, the Family Educational Rights and Privacy Act, and the European Union’s Data Protection Directive and Safe Harbor provisions.
For 2010 and 2011, Malek has been recognized as a leader in her field by Chambers USA, which has described her as “well versed in transactional and regulatory matters, with particular insight into privacy issues relating to electronic and personal health records.”
